A former federal criminal prosecutor focusing on financial fraud and computer and intellectual property crime, who tried upwards of 15-20 jury and bench trials through verdict and appeal, David has specialized in civil litigation in federal and state courts in the nearly 15 years since. His more recent work has on private business litigation — spanning breach of contract to breach of fiduciary duty, negligence, defamation, real estate and construction claims, fraud and misrepresentation, unfair business practice, and intellectual property infringement and trade secret claims. David has handled trials, motions, arbitrations, mediations, and settlements that resulted in judgments of six and seven figures, as well as injunctive relief for individuals, small businesses and larger companies in the Bay Area and throughout California. Most recently, David obtained a defense verdict from a federal jury in a professional negligence action, a million-dollar-plus arbitration award on behalf of a client in the high-tech sector, and attractive settlements for high-tech clients following in one case prosecution of, and in another case defense of, intellectual property infringement.

David has taught trial and appellate skills, legal writing and legal ethics to law students and practitioners, has spoken at conferences and on panels covering a wide range of criminal, civil and international comparative law topics, and has served as a temporary judge in the San Francisco and Los Angeles County courts. He recently completed a stint aimed at strengthening the legal capacities and case production of a civil rights non-governmental organization in the Dominican Republic, and has done similar work in the criminal justice sphere in Bulgaria and Venezuela.

David is particularly sensitive to limiting litigation costs for his clients whenever possible through strategic case planning and close attention to his clients’ needs and concerns – but is always prepared and equipped to take a case through trial or arbitration if in the best interest of his clients. Being trial-ready is a formula which has served David’s past clients well in maximizing recovery or minimizing liability, even in those cases which settle prior to trial.
